Serial activist petitioner and advocate Manohar Lal Sharma has prepared a writ petition claiming contempt of court by four respondents, namely the intern who alleged sexual harassment of a judge, the Times of India and Legally India that first published her claims, and to the Attorney General of India Goolam Vahanvati for petitioning the Supreme Court to investigate this case under the Vishaka judgment’s sexual harassment guidelines.

In his petition, of which Sharma disseminated a softcopy to a number of journalists, he also prayed for the Supreme Court to start an inquiry into the respondents “for their concocted criminal action against the judicial systems”, and for the Central Bureau of Investigations (CBI) to investigate “facts and evidence” to assist the court in such inquiry.

In the grounds of the petition, Sharma stated:

Because sheer reference of sexual harassment by a lady cannot be accepted as a offence . However impugned statement does not contain name , at e, time and place where such action was done. It does not reveal even the date of the offence . Name of the room /hotel /court does not reflected in the statement. It is prima facie have no value but it was published under a concocted game by the respondent girl having hand with other conspirators just to defame the judiciary referring period of December 2012. […]

Because under concocted conspiracy legal journal also published her interview in their web edition but did not disclose name and place and time as well as date of the incidents. It do not disclose name of city too. Which further prove that it is published under a concocted game and planning.

Because times of India also published the same story without having any evidence in hand just on the basis of above said publication in block and legal India interview. Perhaps times of India were much interest to get cheep publicity which has managed the image and reputation of the Judiciary Supreme court and its judges. […]

Because petitioner learnt through ancients books which has already disclosed and established several times that lady never speak truth .Even for a short benefit or for revenge for denial her demand she can go upto any extent for revenge. NO one can control her revenge/ greed. Upon disclosure of truth she put herself as a poor helpless in the world. All empires and fight happened due to her ego and greed . [sic, as applicable]

The internal judicial inquiry of three judges constituted by the Chief Justice of India (CJI) on Tuesday, is due to hear the allegations of the intern on Monday afternoon.

Can’t Mr. Sharma get his English corrected by somebody before filing the petition in the court? Hogging lime light through such manners and gimmicks can never be enduring. I wish he had not quoted the so-called scriptures which have ordained that women should be treated like animals. People with such perverted mentality have no right to claim as civilized ones.

Mr Sharma is a greatest nuisance. I do not understand why Courts is so reluctant to impose fines on frivolous petitions filed by him merely on news papers.

Does'nt his wording of the petition violate any code of conduct or ethics of an advocate, as he himself as a lawyer is the petitioner and is defaming women which is against the Directive Principles of the Constitution?

Isn't ML Sharma the same guy who was defending some of the accused in the Delhi Nirbhaya Rape case. He has been known to make controversial statements to get some attention. He did that in the rape case and now he is doing it here too. I think he wants publicity, doesn't seem to care whether its bad or good.

Also, how is this contempt of the judicial system? Is he suggesting that judges have immunity over any case which may be filed against them. Sounds bizarre to me. I hope this is dismissed right away.

Have been trying to get around to several other stories, including law firms and other cases, but alas between reporting this one, the phone has been off the hook about this case, and there hasn't been much time left for other stories.

Hope to get back to normal schedule this week but I think at least the past week this story has rightly taken priority.

The sad truth is that most lawyers in India speak and write such poor English, which makes them unemployable. Many of them, out of sheer resentment, are blocking liberalization because they do not want to see young, "smart" lawyers who speak English fluently getting well-paid jobs in foreign law firms.

Before you mock ML Sharma, please realize that he epitomizes the average Indian lawyer and is more influential than you think.

If he gets the gold medal for insensitivity then the NUJS VC gets a silver. As reported in Outlook, the following is what the NUJS VC has said:

When contacted about the incident by Outlook, the vice-chancellor of the university said “it’s really quite embarrassing”. He would not officially confirm or deny whether SJ had worked for the judge in 2012 on the said date. He insisted he was unaware whether any student had been sent to work with the judge. He said there was no complaint yet and therefore the university could not be expected to act on a blog post. On the judge’s affiliation with the university: “He is taking a class. It will continue....
“No one from the university is willing to speak out against the judge because of the close equation that he shares with the vice-chancellor. They are friends and he had appointed the V-C,” says a faculty member who did not wish to be named.

I guess some people have no or less work in the office or even at home. The problem is that people who create work for themselves like the aforementioned man, cause nuisance to others. We all know this matter is going to be thrown out like all the frivolous ones, but this guy is teaching new constitutional law altogether. I didn't know one can file a writ for contempt of court!!!!!!!!!!!

These types of people are slowly becoming problem in all courts. No wonder the leverage given to these types of petitions may bring halt to judicial system for the genuine petitioners. No wonder the other day a petitioner/NGO may file a petition to stop people laughing at metro stations.

based upon this man's prior petitions/ applications including in the coal scam case etc, he appears to be filing on behalf of the PMO/ other influential entities and his petitions etc are being used to facilitate a cover-up.

I think most of the readers have missed the point that the petition has not yet been filed. The above report begins by saying that Mr. Sharma has "prepared a writ petition" but does not mention about its filing or about the court being seized of the matter. In case its not filed yet, Mr. Sharma would do well not to file it at all.

Actually, other papers have reported that he has filed the petition.

All I know is that he has circulated the petition to media but I haven't enquired further.

My friends,

I read the affidavit of Mr. Sharma trying to haul the hapless intern over the coals without an iota of concern for her plight. The affidavit as reported in your journal is poorly written and seems to defame women by saying that women are prone to revenge and greed and that ladies never speak the truth. Women organizations may be upset and may try to take the petitioner to Court for defamation. The Court would do well to brush this petition aside. The Court committee is seized of the issue and let us await their finding.

LI and all other media, why give so much importance and coverage to this ML Sharma? Who is he anyway? Someone who is looking for cheap publicity - sharing his PIL application with the media even before filing it with the court. Why is this PIL so important that it has to be given coverage by the media. Maybe, if the court does admit this petition, the media may report the same. But till then, there is no point in this as this PIL is not something of national importance. By giving this guy coverage, we are actually playing into the hands of this guy. He is a hopeless lawyer, always looking for publicity, with scant regard for women. Everyone is taking the Jolly LLB route to be (in)famous and to grab eyeballs. Helps them to sell themselves before hapless prospective clients

Shocking language in the petition. The complainant law intern, should certainly consider filing a defamation case against the person who has filed the writ in Supreme court. I fail to understand how the mere failure to name the judge in the article has led to a statement "concocted game by the respondent girl" in the writ petition.

Infact it seems like that the writ petition has been filed as a Publicity stunt. This needs to stop.

Such a language I think should not have been used about the women fraternity flatly as is shown.As regards the Times of India,it has also published the petition prepared by Mr Sharma Advocate,rather ,the Times of India has published what has been given to it ,I think it is rather a daring correct thing and at the same time the initiative by Sh Vehnvati is also appreciable,but I think the matter should be got enquired and investigated through the quite independent agency.This is not the first time that the allegations as such have been levelled,earlier also Justice Arun Madan of perhaps Rajasthan HC was indicted in a three judges enquiry headed by Justice BK Roy then CJ P&H High court,but justice Arun Madan was the sitting HC Judge, in this case,in house enquiry seems to be no righteousness rather some independent enquiry should be conducted so as to inspite faith in the system.No body should be above the law,rather law is above the court,as per one SC Judgement.
