KhaitanCo Kolkata in ongoing Bollywood plagiarism epic

Khaitan & Co has won a temporary victory against alleged Bollywood plagiarism in the Calcutta High Court. The firm is representing movie producer Vipul Shah against Sri Venkatesh Films over the currently screening Bengali movie Poran Jay Joliya Re, which Shah alleges is a scene-by-scene "copy-paste" of his film Namastey London.

Justice N Pathereya decided in Shah's favour last week Monday (10 August) ordering Sri Venkatesh Films to stop screening the movie immediately.

However, the Bengali company filed an immediate appeal to the division bench of the Calcutta High Court, which decided on Thursday 10 August to stay the injunction.

The Court also ordered the film's proceeds to be deposited in a separate account until the outcome of the hearings, which are currently ongoing.

Khaitan & Co partner Aniket Agarwal is representing Shah assisted by associate Anshumala Bansal, with advocates S. N. Mookerjee and Ranjan Bachawat appearing on their behalf.

Sri Venkatish Films is represented by Kolkata lawyer Satyabrata Chakraborty, who has instructed senior counsel Sudipta Sarkar and Pratap Chatterjee.

The lawyers declined to comment.

The Kolkata case follows the recent $200,000 out-of-court settlement from BR Films with Twentieth Century Fox, which alleged that the forthcoming Indian movie Banda Yeh Bindaas Hai was an illegal remake of Hollywood's Oscar-winning 1992 crime caper My Cousin Vinny.
